Terms of Use

Last updated: February 2025

1. Acceptance of Terms

By downloading, installing, or using the Senior Care mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms constitute a legal agreement between you and Juma Apps LLC ("Company", "we", "us", or "our").

2. Description of Service

Senior Care is a mobile application designed to connect caregivers with elderly individuals (seniors) to facilitate care coordination. The App provides features including but not limited to real-time location tracking, panic alerts, medication management, wellness check-ins, appointment scheduling, expense tracking, and geofence monitoring.

3. Eligibility

You must be at least 18 years old to create an account. By using the App, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are setting up the App for a senior, you represent that you have the necessary authorization to do so on their behalf.

4. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain and update your information to keep it accurate.
  • Maintain the security and confidentiality of your login credentials.
  • Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

5. Subscription and Payments

Senior Care offers both free and premium subscription tiers:

  • Free Plan: Basic features including up to 2 caregivers per senior.
  • Weekly Plan: $2.99/week, billed weekly.
  • Monthly Plan: $9.99/month, billed monthly.
  • Yearly Plan: $59.99/year, billed annually.

Subscriptions are managed through Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your device's store settings.

6. Location Services — Foreground and Background Collection

The App collects precise GPS location data from senior users' devices in both the foreground (while the App is open and in use) and the background (while the App is closed or not actively in use). This is a core feature of the App and is necessary to provide continuous safety monitoring.

6.1 Why We Collect Location Data

Location data is collected solely to enable the following caregiving features:

  • Real-time location sharing: Displaying the senior's current position to connected caregivers on a live map, so they can verify the senior's safety at any time.
  • Geofence monitoring: Detecting when the senior enters or exits predefined safe areas (e.g., home, neighborhood) and sending automatic alerts to caregivers.
  • Panic alerts: Attaching the senior's current GPS coordinates to emergency alerts so caregivers can locate them quickly during an emergency.
  • Stale location detection: Alerting caregivers when the senior's location has not updated for an extended period, which may indicate a device issue or emergency.

6.2 Background Location Access

Senior Care requires "Allow all the time" (Android) or "Always" (iOS) location permission on the senior's device. Background location access is essential because:

  • Caregivers need to see the senior's location even when the senior is not actively using the App.
  • Geofence exit/entry alerts must be triggered in real time, regardless of whether the App is in the foreground.
  • Panic alerts must include the most recent GPS coordinates, even if the App is running in the background.
  • Stale location monitoring requires continuous position updates to detect when tracking stops unexpectedly.

Without background location access, the App cannot provide continuous safety monitoring, and core features such as geofence alerts and real-time location sharing will not function.

6.3 Consent and Control

  • Location collection is always consent-based. The App requests location permission explicitly during setup, and seniors must grant permission through the operating system prompt.
  • Seniors and caregivers can revoke location permission at any time through the device's Settings app (Settings > Apps > Senior Care > Permissions > Location on Android; Settings > Privacy & Security > Location Services > Senior Care on iOS).
  • Revoking location permission will disable real-time tracking, geofence alerts, and location-based panic alerts. Other features (medications, wellness, appointments) will continue to work normally.
  • Location data is only shared with caregivers the senior has explicitly connected to via a unique connection code. No location data is shared with third parties, advertisers, or any other users.

6.4 Data Handling

  • Location data is transmitted over encrypted connections (TLS/SSL) and stored securely with row-level security policies ensuring only authorized caregivers can access it.
  • Location data is retained for as long as the senior's account is active. Upon account deletion, all location data is permanently deleted within 30 days.
  • We do not sell, share, or use location data for advertising, analytics, or any purpose other than the caregiving features described above.

7. User Conduct

You agree not to:

  • Use the App to track or monitor anyone without their knowledge and consent.
  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Interfere with or disrupt the App's functionality or servers.
  • Reverse engineer, decompile, or disassemble any part of the App.
  • Use the App to harass, threaten, or harm any person.

8. Medical Disclaimer

Senior Care is not a medical device and is not intended to replace professional medical care, advice, or emergency services. The medication management and wellness features are provided as organizational tools only. Always consult healthcare professionals for medical decisions. In case of a medical emergency, call your local emergency number (e.g., 911) immediately.

9. Limitation of Liability

To the maximum extent permitted by law, Juma Apps LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, damages related to:

  • Inaccurate or delayed location data.
  • Failure to receive alerts or notifications.
  • Missed medication reminders or wellness check-ins.
  • Any decisions made based on information provided by the App.

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the exclusive property of Juma Apps LLC and are protected by copyright, trademark, and other intellectual property laws.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App settings.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
